KAAMILAN TRAVEL AND TOURS (“KAAMILAN”, “we”, “us”, or “our”) is a duly registered business operating an online travel and booking platform. These Terms and Conditions (“Terms”) govern your access to and use of the KAAMILAN website, digital platform, tools, and services (“Platform”). By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use immediately.

1. DEFINITIONS

  • “Platform” means the KAAMILAN website and related services.
  • “User” / “Customer” means any individual or entity accessing or using the Platform.
  • “Provider” means airlines, hotels, tour operators, transport providers, or other third parties offering services through the Platform.
  • “Booking” means a confirmed reservation made through the Platform.
  • “Services” means travel-related services facilitated through KAAMILAN.

2. ROLE OF KAAMILAN

KAAMILAN acts solely as an intermediary between Users and independent Providers. KAAMILAN does not own, manage, operate, or control Providers and does not provide travel services directly unless expressly stated in writing.

3. ELIGIBILITY TO USE THE PLATFORM

By using the Platform, you represent that:

  • You are at least 18 years of age or legally capable of entering binding agreements.
  • You will use the Platform only for lawful purposes.
  • Information provided is accurate, complete, and up to date.

KAAMILAN reserves the right to suspend or terminate access if eligibility requirements are breached.

4. BOOKINGS AND CONFIRMATIONS

Bookings are subject to availability and Provider acceptance. A booking is confirmed only after:

  • Successful payment processing, and
  • Issuance of confirmation details.

Users are solely responsible for verifying booking details. Errors may result in cancellation, penalties, or denial of service by Providers.

5. PRICES, FEES, AND TAXES

Prices displayed may include service fees and applicable taxes unless stated otherwise. Prices are subject to change due to availability, currency fluctuations, or Provider updates. KAAMILAN does not guarantee price accuracy beyond Provider confirmations.

6. PAYMENTS

Payments are processed through approved third-party providers including mobile money, banks, and card gateways. KAAMILAN does not store sensitive payment credentials. Payment delays, failures, or reversals caused by third parties are outside KAAMILAN’s control.

7. REFUNDS, CHANGES, AND CANCELLATIONS

Refunds and changes are governed by Provider policies. Some bookings may be non-refundable or subject to penalties. KAAMILAN may assist with requests but does not guarantee approval.

Erroneous payments are reviewed on a case-by-case basis following verification.

8. THIRD-PARTY PROVIDERS

Providers are solely responsible for:

  • Service delivery
  • Safety standards
  • Compliance with laws and regulations

KAAMILAN is not liable for Provider acts or omissions, including delays, cancellations, injuries, losses, or service failures.

9. TRAVEL RISKS & DISCLAIMERS

Travel involves inherent risks including delays, cancellations, health risks, weather conditions, and government restrictions. Users assume all risks associated with travel.

KAAMILAN does not provide travel insurance and strongly recommends Users obtain appropriate coverage.

10. USER CONDUCT

Users agree not to:

  • Misuse the Platform
  • Engage in fraudulent, abusive, or unlawful behavior
  • Interfere with Platform operations
  • Attempt unauthorized access

KAAMILAN may restrict or terminate access for violations.

11. INTELLECTUAL PROPERTY

All content on the Platform is the property of KAAMILAN TRAVEL AND TOURS or its licensors. Unauthorized use, reproduction, or distribution is prohibited.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • KAAMILAN shall not be liable for indirect, incidental, or consequential damages.
  • Total liability shall not exceed the amount paid for the relevant Booking.

13. INDEMNIFICATION

Users agree to indemnify and hold harmless KAAMILAN TRAVEL AND TOURS from claims, losses, damages, liabilities, and expenses arising from misuse of the Platform or violation of these Terms.

14. FORCE MAJEURE

KAAMILAN shall not be liable for failure or delay due to events beyond reasonable control, including natural disasters, pandemics, strikes, system failures, or government actions.

15. TERMINATION

KAAMILAN may suspend or terminate access at any time without notice if these Terms are violated or if required by law.

16. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
